Seven Things To Know When You Receive A Notice Of Investigation From The Department Of Health

THE HEALTH LAW FIRM WINS APPEAL IN BOARD OF PHARMACY LICENSE REVOCATION CASE

Orlando, Fla. – June 25, 2013 – A Florida pharmacist whose license was revoked by the Florida Board of Pharmacy won a reversal because of an appeal filed by Attorneys George F. Indest III, Lance O. Leider and Michael L. Smith of The Health Law Firm. Mr. Indest, a board certified health law attorney, is the President and Managing Partner of The Health Law Firm, with offices in Central Florida and Colorado.

During the April 2012, Florida Board of Pharmacy meeting, the Board voted to revoke the pharmacist’s license to practice despite him not being in attendance at the meeting.

Mr. Indest and his team at The Health Law Firm were brought on to assist the pharmacist in appealing the Board’s decision. On appeal, in response to a brief filed by The Heath Law Firm, the Department of Health (DOH) properly conceded that the order must be reversed, and the matter remanded for a new hearing, because the Board failed to properly notify the pharmacist of the hearing.
